As of November 3, 2020, voters in the state of Montana decided to legalize recreational marijuana. Two ballots were introduced and approved. I-190 creates rules for marijuana use, including a 20% tax and the option for individual counties to prohibit dispensaries. CI-118 amended the Montana Constitution to allow the state to set the minimum buying age to 21. However, the state of Montana has yet to set up rules, regulations and begin the process for applications for dispensaries. This means that you cannot buy recreational marijuana legally as of yet.

A person over the age of 21 is allowed to possess up to 1 ounce of marijuana, or 8 grams of concentrate (a little over 1/4 oz.), under the law. A person may grow up to 4 mature cannabis plants and 4 seedlings in their own private residence. Any amount of cannabis flower produced that measures over one ounce should be locked away and kept out of plain sight in a private space. If you are renting or using another property, you must have written permission from the owner allowing you to grow cannabis.

Consuming cannabis in public spaces is still prohibited, unless it is a designated area where you’re allowed to do so. Employers still have the right to enforce their workplace drug policies, and local governments have the authority to adopt ordinances or regulations on commercial businesses. Understandably, operating a vehicle under the influence of marijuana is prohibited.

3. Submit your doctor’s certificate and information to the State website. If you are approved for a medical marijuana card, you’ll be sent a copy of your certificate letter via email. You choose whether you want to grow your medical cannabis or choose a dispensary. You cannot do both. Whether the new recreational laws will affect this ruling, we cannot say for definite as of yet.

Patients must be 18 years old or over in order to qualify for a medical marijuana card. Patients who are minors (under 18) or those who cannot obtain medical cannabis for themselves must have a registered caregiver. Caregivers must be 21 years old or over.

In Montana, you can get a medical marijuana card for a minor with parental/guardian consent. Medical marijuana has been proven to be effective for many conditions suffered by children. 2004 – Voters approved Initiative 148, removing state-level criminal penalties for those with a medical marijuana card.

2011 – SB 423 is passed and the application process changed somewhat. SB 423 meant patients required a Montana-specific driver license or state-issued state ID card, as well as a second certificate by a physician when patients were using cannabis for chronic pain.

2016 – Initiative 182 is approved, and some of the restrictions on medical marijuana in SB 423 and SB 143 are changed, reinstating the state’s original medical marijuana laws. This means that patients with a debilitating illness and physician’s certificate are allowed to access marijuana for medicinal purposes.
